Terms of Service

1. Acceptance of Terms

Welcome to GridStreamr. By accessing or using our mobile application, website, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and GridStreamr ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Apple App Store Users: If you are using the Licensed Application from the Apple App Store, these Terms constitute an End-User License Agreement ("EULA"). You acknowledge that this EULA is concluded between you and GridStreamr only, and not with Apple. GridStreamr, not Apple, is solely responsible for the Licensed Application and the content thereof. The EULA may not provide for usage rules for Licensed Applications that are in conflict with the Apple Media Services Terms and Conditions as of the Effective Date.

2. Scope of License

The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

This license does not allow you to:

  • Use the Licensed Application on any device that you do not own or control
  • Copy, modify, adapt, redistribute, sell, lease, sublicense, or create derivative works of the Licensed Application
  • Reverse engineer, decompile, or disassemble the Licensed Application
  • Remove any proprietary notices or labels from the Licensed Application

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Be at least 13 years of age (or the applicable age of digital consent in your jurisdiction)
  • Not create multiple accounts or use the Service if we have previously terminated your account

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Service Description

GridStreamr allows you to:

  • Organize playlists using different formats (M3U URLs, Xtream Codes providers)
  • Create customized playlists based on entries from existing playlists
  • View EPG (Electronic Program Guide) data for your playlists
  • Watch streaming content using our built-in video player
  • Create favorites and custom categories for better organization
  • Sync your playlists and preferences across devices

3.1 What We Are NOT

Important Clarification: While GridStreamr helps you organize playlists and watch content, we are NOT a content provider or streaming service:

  • We do not host, store, or provide any video or audio content
  • We do not transmit or deliver media content to you
  • We do not control, modify, or take responsibility for content from external sources
  • The built-in video player displays content that streams directly from your configured sources
  • Content flows from your sources to your device; we provide the tools to organize and view it

3.2 Your Content Sources

You provide your own content sources (M3U URLs, Xtream Codes credentials, etc.). You are solely responsible for:

  • Ensuring you have legal rights to access any content sources you add
  • Complying with the terms of service of your content providers
  • Any costs, subscriptions, or fees associated with your content sources
  • The legality and appropriateness of content from your sources
  • Any violations of copyright, licensing, or other legal requirements

We do not verify, endorse, or take any responsibility for the content sources you configure or the content they provide.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any laws, regulations, or third-party rights
  • Configure or access content sources you do not have legal rights to access
  • Add or share playlists containing pirated or illegally obtained content
  • Violate copyright, licensing, or intellectual property rights
  • Attempt to circumvent any security features of the Service
  • Interfere with or disrupt the Service or servers
  • Use the Service for any illegal or unauthorized purpose
  • Reverse engineer, decompile, or disassemble the app
  • Use automated scripts or bots to access the Service
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Misrepresent GridStreamr as a content provider or streaming service

Your Responsibility: You acknowledge that you are using GridStreamr solely to organize and manage playlists from legitimate sources you have legal access to. We reserve the right to terminate accounts that we reasonably believe are being used to access illegal or pirated content.

Violation of this Acceptable Use Policy may result in immediate termination of your account without refund.

6. Intellectual Property Rights

6.1 Our Rights

The Service, including its original content, features, and functionality, is owned by GridStreamr and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

6.2 Your Rights

You retain all rights to the playlist configurations and data you create in the Service. By using the Service, you grant us a limited license to store and process your data solely to provide the Service to you.

6.3 Third-Party Content

All content accessed through external sources remains the property of the respective content owners. We claim no ownership or rights to such content.

6.4 Intellectual Property Infringement Claims

You acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party's intellectual property rights, GridStreamr, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

6.5 Third-Party Metadata, Subtitle, and AI Integrations

GridStreamr supports optional integrations with third-party services such as The Movie Database ("TMDB"), OpenSubtitles, Google Gemini, OpenAI, and similar services that may be made available from time to time. These integrations may allow you to supply your own API keys, credentials, or account information in order to retrieve metadata, subtitles, AI-generated classifications, enrichment suggestions, or other supplementary information for certain features. GridStreamr is not affiliated with, endorsed by, sponsored by, or in any partnership with those providers unless explicitly stated otherwise, and all such services are third-party services outside our control.

GridStreamr does not provide third-party API keys or third-party service accounts unless expressly stated otherwise. We are not responsible for any data, content, subtitles, metadata, AI output, classifications, enrichment suggestions, availability, accuracy, completeness, legality, performance, moderation, security, outages, suspensions, billing, or other services provided by any third-party integration provider. Any use of such third-party services is solely at your own risk.

You are solely responsible for obtaining, safeguarding, and lawfully using your own third-party API keys, credentials, and accounts; for complying with the applicable terms of use, API rules, attribution requirements, privacy policies, data processing terms, and acceptable use policies of those providers; and for your use of any third-party data or output returned to you. Any dispute regarding third-party data, services, AI output, pricing, account restrictions, suspensions, or provider conduct is solely between you and the relevant provider.

If you choose to enable AI-related features, you acknowledge that channel names, playlist metadata, subtitle search queries, title information, and other related data that you select or submit may be transmitted to the third-party AI provider you choose in order to generate results. You are solely responsible for deciding whether to enable such features and whether the data you submit may lawfully be shared with that provider.

Unless we expressly state otherwise for a specific feature, any AI-generated recommendation, classification, enrichment suggestion, image reference, or other digital item generated from your use of third-party integrations, as well as any images or similar digital items that you configure through the Service, are not owned by GridStreamr and are not stored on GridStreamr's servers. Such items may instead remain on your device, in your configured source, or with the applicable third-party provider, subject to that provider's own terms and policies.

7. Maintenance and Support

GridStreamr is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA, or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

8. Warranty

GridStreamr is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. This EULA provides that, in the event of any failure of the Licensed Application to conform to any applicable warranty, the End-User may notify Apple, and Apple will refund the purchase price for the Licensed Application to that End-User. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be GridStreamr's sole responsibility.

9. Product Claims

You acknowledge that GridStreamr, not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA may not limit GridStreamr's liability to you beyond what is permitted by applicable law.

10. Legal Compliance

You must represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law, including, without limitation, the development, design, manufacture, or production of nuclear, missile, or chemical or biological weapons.

11. Third Party Terms of Agreement

You must comply with applicable third party terms of agreement when using the Licensed Application. For example, if the Licensed Application uses VoIP services, then you must not be in violation of your wireless data service agreement when using the Licensed Application. You are responsible for ensuring compliance with all applicable third-party terms of service, including but not limited to content provider agreements, streaming service terms, data service agreements, TMDB terms, OpenSubtitles terms, Google Gemini terms, OpenAI terms, and any applicable API, attribution, privacy, data processing, or acceptable use rules imposed by those providers.

11.5 Government End Users

The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.

12. Subscriptions and Payments

12.1 Subscription Plans

We offer auto-renewing subscription plans (for example, Premium) with different features, and separate consumable in-app products (for example, GAI / AI credit packs) as described in Section 12.5. When you purchase a subscription:

  • You agree to pay the subscription fee for the selected plan
  • Subscriptions automatically renew unless canceled before the renewal date
  • Prices are subject to change with notice for new subscribers
  • You will be charged through your Apple ID, Google Play account, or other applicable payment method provided by the store

Where a subscription is eligible for Family Sharing in the App Store, sharing follows Apple's rules for that product; consumable GAI purchases are not shared like subscription seats unless we state otherwise in the app or store listing.

12.2 In-App Purchases and Store Billing

Apple App Store: In-app purchases and subscriptions you buy through the App Store are billed and processed by Apple. Payment, tax, renewals, and first-line refund and billing support for those charges are subject to the Apple Media Services Terms and Conditions and Apple's support and refund processes (for example, Report a Problem). Nothing in these Terms overrides Apple's or your mandatory rights under applicable law.

Google Play: In-app purchases and subscriptions you buy through Google Play are billed and processed by Google. Payment, tax, renewals, and refund and billing support for those charges are subject to Google Play's terms and Google Play refund policies and help flows. Nothing in these Terms overrides Google's or your mandatory rights under applicable law.

We use service providers (such as RevenueCat) to help validate entitlements; we do not receive or store your full payment card number from the store. How purchase-related data is processed is described in our Privacy Policy (iOS and Android).

12.3 Free Trial

If we offer a free trial:

  • You may be charged automatically when the trial ends unless you cancel
  • Only one free trial per user
  • We reserve the right to determine trial eligibility

12.4 Cancellation and Refunds

For iOS subscriptions:

  • Manage subscriptions through your iOS Settings → Apple ID → Subscriptions
  • Cancellation takes effect at the end of the current billing period
  • Except where applicable law requires otherwise, we do not refund partial subscription periods; refund eligibility for charges processed by Apple is determined under Apple's refund policies
  • For refund requests on Apple-billed purchases, use Apple's support channels (for example Report a Problem)

For Android subscriptions:

  • Manage subscriptions through Google Play → Payments & subscriptions
  • Cancellation takes effect at the end of the current billing period unless stated otherwise by Google Play
  • Except where applicable law requires otherwise, refund eligibility for charges processed by Google Play is determined under Google Play's refund policies
  • For refund requests on Google Play–billed purchases, use Google Play's help and refund flows

12.5 AI credits (GAI)

Certain AI-powered features may use optional AI credits ("GAI" or similar branding in the app), which are consumable digital balance purchased or granted in connection with the Service.

  • Premium required to purchase: In-app purchases that add GAI balance are offered only to users who have an active Premium subscription at the time of purchase. We may change eligibility or pricing with reasonable notice where required.
  • GAI is not cash or currency, has no monetary value outside the Service, is non-transferable, and is depleted when you use features that consume it. Consumption: GAI is used when you run features that spend credits. To the maximum extent permitted by applicable law, once GAI has been consumed (credits have been spent on a completed or partially completed operation), the corresponding amount is not returnable or reversible as digital performance already provided - similar to other consumable in-app content - while your mandatory rights (if any) under consumer law remain unaffected.
  • Refunds, chargebacks, and abuse: Nothing in these Terms limits any mandatory rights you may have under applicable consumer protection law. Where the law and store rules allow, purchases of GAI that have not been consumed may still be final; refund or adjustment eligibility for amounts charged through the App Store or Google Play is primarily decided by Apple or Google under their respective policies, in addition to any statutory rights in your country or region. If a payment is refunded, reversed, or charged back, or we detect duplicate entitlement, abuse, or fraud, we may reduce, suspend, or revoke the corresponding GAI balance or access to features that depend on it.

13. User Content and Playlist Configurations

You are responsible for all playlist URLs, configurations, customizations, and organizational data you create in the Service ("User Content"). You represent and warrant that:

  • You have the legal right to access all content sources you configure in the app
  • Your playlist configurations do not link to illegal or pirated content
  • Your User Content does not violate any laws, copyrights, or third-party rights
  • Your User Content does not contain malicious code, viruses, or harmful elements
  • You have any necessary subscriptions, licenses, or permissions for your content sources

No Content Liability: Because we do not host, provide, or control any media content, and only store your organizational configurations, you acknowledge that:

  • We cannot verify the legality of content sources you configure
  • We are not responsible for content accessed through your configured sources
  • You bear sole responsibility for ensuring your content sources are legal
  • We may remove playlist configurations that we believe link to illegal content

We reserve the right to remove any User Content that violates these Terms or links to illegal content, without prior notice.

14. Privacy and Consent to Use of Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information, including payment-related and entitlement data (for example, via stores and our subscription tooling) and GridStreamr-hosted AI (GAI) as described there. By using the Service, you agree to our Privacy Policy.

14.1 Consent to Use of Data

You agree that GridStreamr may collect and use technical data and related information (including but not limited to technical information about your device, system and application software, and peripherals) that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. GridStreamr may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

15. Service Availability and Modifications

15.1 Availability

We strive to provide reliable service for organizing playlists and viewing content, but we cannot guarantee:

  • Uninterrupted or error-free operation of our Service
  • That defects will be corrected immediately
  • That the Service will meet your specific requirements
  • The availability, reliability, streaming quality, or content from third-party sources you configure
  • The functionality or uptime of external playlist providers (M3U sources, Xtream servers, etc.)
  • The accuracy or availability of EPG data from third-party sources

Third-Party Dependencies: Our Service relies on your configured external sources. We are not responsible for issues with your content providers, including downtime, content availability, streaming quality, or termination of service by those providers.

15.2 Modifications

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service
  • Update the app and push updates to your device
  • Change these Terms with notice

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR AVAILABILITY

We do not warrant that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • Your configured content sources will remain available or functional
  • Content from third-party sources will be legal, accurate, or of acceptable quality

WE SPECIFICALLY DISCLAIM ANY WARRANTY, REPRESENTATION, OR GUARANTEE REGARDING:

  • THE LEGALITY OF CONTENT FROM YOUR CONFIGURED SOURCES
  • THE AVAILABILITY OR RELIABILITY OF EXTERNAL CONTENT PROVIDERS
  • THE QUALITY, ACCURACY, OR COMPLETENESS OF CONTENT FROM EXTERNAL SOURCES
  • EPG DATA FROM THIRD-PARTY PROVIDERS
  • DATA OR SERVICES FROM TMDB, OPENSUBTITLES, GOOGLE GEMINI, OPENAI, OR ANY OTHER THIRD-PARTY INTEGRATION PROVIDER
  • ANY AI-GENERATED OUTPUT, CLASSIFICATION, ENRICHMENT SUGGESTION, SUBTITLE MATCH, OR METADATA RETURNED BY A THIRD-PARTY PROVIDER
  • THE ACCURACY, SUITABILITY, OR COMPLETENESS OF GRIDSTREAMR-HOSTED AI (GAI) OUTPUT; GAI IS PROVIDED "AS IS" (SEE OUR PRIVACY POLICY FOR DATA PRACTICES)

Optional integrations (including bring-your-own API keys or third-party AI providers): You are responsible for any content, credentials, or data you choose to send to those services; their terms and privacy practices apply. See the Privacy Policy for how hosted GAI differs from optional third-party features.

You acknowledge that GridStreamr provides tools to organize playlists and watch content from your own sources, but we have no control over, do not host, and are not responsible for any content accessed through external sources you configure.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRIDSTREAMR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses
  • Damages resulting from your access to or inability to access the Service
  • Damages resulting from any content obtained from the Service or your configured content sources
  • Damages resulting from your use of or reliance on third-party integrations, including TMDB, OpenSubtitles, Gemini, OpenAI, or similar providers
  • Unauthorized access to or alteration of your data
  • Damages arising out of or related to your use of or inability to use the Licensed Application, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if GridStreamr has been advised of the possibility of such damages

In no event shall GridStreamr's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

Jurisdiction-Specific Limitations: Some jurisdictions do not allow the exclusion of implied warranties, the limitation of liability for personal injury, or of incidental or consequential damages, so the above limitations and exclusions may not apply to you. In such jurisdictions, GridStreamr's liability will be limited to the maximum extent permitted by applicable law, but in no event shall GridStreamr's liability exceed the minimum amount required by such applicable law, and in any case, GridStreamr's total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater, except where such limitation is specifically prohibited by mandatory law.

18. Indemnification

You agree to defend, indemnify, and hold harmless GridStreamr and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including copyright or privacy rights
  • Your User Content
  • Your use of content sources you add to the Service
  • Your use of third-party integrations, API keys, credentials, or accounts, including any claims arising from data you submit to TMDB, OpenSubtitles, Gemini, OpenAI, or similar services

19. Termination

19.1 By You

You may terminate your account at any time through the app settings. Upon termination:

  • Your right to use the Service immediately ceases
  • Your data may be deleted in accordance with our data retention policy
  • Active subscriptions will remain active until the end of the billing period

19.2 By Us

We may terminate or suspend your account immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the Service or harm other users
  • Fail to pay subscription fees

20. Dispute Resolution

20.1 Informal Resolution

Before filing a claim, you agree to contact us at gridstreamr@gmail.com to resolve any disputes informally. We will attempt to resolve the dispute within 60 days.

20.2 Arbitration

If we cannot resolve the dispute informally, you agree that any dispute will be resolved through binding arbitration, except that:

  • Either party may seek injunctive relief in court
  • Disputes regarding intellectual property rights may be brought in court
  • You may bring claims in small claims court if they qualify

20.3 Class Action Waiver

You agree to bring claims against us only in your individual capacity and not as part of any class or representative action.

21. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

Any disputes not subject to arbitration shall be resolved in the courts of the United Arab Emirates.

22. Apple-Specific Terms and Third Party Beneficiary

If you are using the iOS app from the Apple App Store, these additional terms apply:

You acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.

This EULA is between you and GridStreamr only, and not with Apple. Apple is not responsible for the Licensed Application or the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

23. General Provisions

23.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GridStreamr regarding the Service.

23.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

23.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

23.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may freely assign these Terms.

23.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, pandemics, or labor disputes.

25. Acknowledgment

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

Apple App Store Users: By downloading and using the Licensed Application from the Apple App Store, you acknowledge that this EULA is concluded between you and GridStreamr only, and not with Apple. You acknowledge that you have reviewed the Apple Media Services Terms and Conditions and that this EULA complies with those terms.
